Nevada Land Trust
Nevada has what is known as a “community land trust,” where in order to provide for affordable housing, an organization, typically a non-profit corporation with tax exempt status, acquires parcels of land that are held in perpetuity primarily for conveyance under long-term ground leases. Such organization transfers ownership of any structural improvements located on the leased parcels to the lessees. Then, when leasing such parcels, the organization retains as a condition of the lease a right to purchase any structural improvements at a price determined by a formula that is designed to ensure that the improvements remain affordable to low- and moderate-income persons in perpetuity. The organization has its corporate membership open to any adult resident of a particular geographic area that is specified in the bylaws of the organization. Also, what in common parlance may be referred to as a “land trust” may legally and more properly referred to as a conservation easement (available in all states), where a not-for profit corporation with tax-exempt status obtains property in order to restrict its use by agreement, where the property is predominantly in its natural, scenic, open, agricultural, or wooded condition so that it is suitable habitat for fish, plants, or wildlife, or so that the property maintains its historical, architectural, archaeological, or cultural significance, or so there is a prohibition on existing land uses from construction or placing of buildings, roads, signs, billboards or other advertising, utilities, or other structures on or above the ground, dumping or placing of soil or other substance or material as landfill or dumping or placing of trash, waste, or unsightly or offensive materials, removal or destruction of trees, shrubs, or other vegetation, excavation, dredging, or removal of loam, peat, gravel, soil, rock, or other material substance in such manner as to affect the surface.
